Terms and Conditions to use Eelam Matrimony
Welcome to Eelam Matrimony Service. Eelam Matrimony, including its officers,
employees and representatives (hereinafter referred to as "Eelam Matrimony")
provides service to its visitors and members (hereinafter referred to as "You")
subject to the following Terms and Conditions, which may be updated by us from
time to time without notice to You. You can review the most current version of
the Terms and Conditions. You and
Eelam Matrimony shall be subject to any posted Terms and Conditions applicable to
such services which may be posted from time to time. You must read and agree to
these Terms and Conditions before You may access or view our Site. Please read
them carefully. By visiting the pages at Eelam Matrimony and/or registering with
the Site, You are agreeing to its terms.
1. Eligibility To Enter Agreement
In consideration of your use of the Service, you represent that you are of
legal age to form a binding contract and are not a person barred from receiving
services under the local laws of applicable jurisdiction in the area of your
normal residency.
2. Description of Service
Eelam Matrimony provides You with access to the matrimonial detail of registered
members and a rich collection of services needed to find a life partner in a
Lankan Tamils traditional way. You also understand and agree that the Service
may include advertisements and that these advertisements are necessary for
Eelam Matrimony to provide the service. You also understand and agree that the
service may include certain communications from Eelam Matrimony, such as service
announcements, administrative messages and the Eelam Matrimony Newsletter, and
that these communications are considered part of Eelam Matrimony membership and
you will have a chance to opt out of them whenever possible. You understand and
agree that the Service is provided "AS-IS" and that Eelam Matrimony assumes no
responsibility for the timeliness, deletion, mis-delivery or failure to store
any user communications or personalization settings. You are responsible for
obtaining access to the Service and that access may involve third party fees
(such as Internet service provider or airtime charges). You are responsible for
those fees, including those fees associated with the display or delivery of
advertisements. In addition, You must provide and are responsible for all
equipment necessary to access the Service.
3. Privacy Policy
Registration Data and certain other information about you is subject to our
Privacy Policy. For more information, see our Privacy
Policy. You understand that through your use of the Site You consent to
the collection and use as set forth in the Privacy Policy of this information,
including the transfer of this information for storage, processing, and use by
Eelam Matrimony and its representatives.
4. Copyright
Eelam Matrimony owns and retains proprietary rights in the Eelam Matrimony site and
the service. The site contains the copyrighted material, logo, trademarks, and
other proprietary information of Eelam Matrimony, and its licensors.
You understand that all information, data, text, photographs, graphics,
messages, audio, video or other materials ("Content"), whether publicly posted
or privately transmitted, are the sole responsibility of the person from which
such Content originated. This means that You, and not Eelam Matrimony, are
entirely responsible for all Content that you upload, post, email, transmit or
otherwise make available via this site.
5. Membership
The membership to use Eelam Matrimony is reserved solely for Tamil Speaking
people with the citizenship or permanent residency of Sri Lanka, having Lankan
Tamil Origin, Descent or Heritage. The right of admission is reserved by the
Eelam Matrimony upon due acceptance of matrimonial profile, and the membership is
not automatic.
5.1. Account and Password
You will receive a password and Profile ID upon completing the Service's
registration process. You are responsible for maintaining the confidentiality
of the password and account, and are fully responsible for all activities that
occur under your password or account. You agree to (a) immediately notify
Eelam Matrimony of any unauthorized use of your password or account or any other
br /each of security, and (b) ensure that you exit from your account at the end
of each session. Eelam Matrimony cannot and will not be liable for any loss or
damage arising from your failure to comply with this requirement.
5.2. Use of your account and Membership
Your Membership is only for your personal use and will not to be assigned,
transferred, licensed or shared so as to be used by any other person/entity.
You are responsible for the Content You post or transmit through Eelam Matrimony
site and service. Your membership will automatically be suspended if you send,
at Eelam Matrimony's discretion, inappropriate message(s) to other members.
Messages sent to members of the opposite gender should be only for the purpose
of finding a life partner. You are not allowed to misuse the site and service
for the purpose of friendship, pen-pal, dating or even flirting etc. You will
not post or transmit any content, information or copyrighted materials without
the prior consent of the person holding its proprietary or licensed rights. You
will not use this site for illegal activities of any kind deemed by the
governing local law enforcements. You will not use this site to instigate or to
promote racism, harassment or hatred towards another member, group or
entity.You will not advertise and/or solicit personal nformation from anyone
under 18.
5.3. Prohibition of Commercial Use
This Eelammatrimony site is for the personal use of individual members and visitors
only and may not be used in connection with any commercial endeavors.
Organizations, companies, and/or businesses may not become members of this
Eelammatrimony site and shall not use the Eelam Matrimony service or site for any
purpose including but not limited to: sending unsolicited commercial e-mail to
members, sending advertisements for other web sites and services in via this
service, or using member personal identifying information for commercial
purposes. Illegal and/or unauthorized uses of the site, including unauthorized
framing of or linking to the site or the sending of unsolicited commercial
email will be investigated, and appropriate legal action will be taken,
including without limitation, civil, criminal, and injunctive redress and/or
termination of membership at Eelam Matrimony's sole discretion. In order to
prevent the sending of unsolicited commercial email or messages to its members,
Eelam Matrimony may take reasonable steps, including the limiting of the numbers
of emails or messages sent or received by a member and electronically filtering
or throttling or terminating e-mail and messages at Eelam Matrimony's sole
discretion.
5.4. Member Disputes
Eelam Matrimony does not extensively control the information provided by other
users that are made available through our system. You may find other members'
information to be offensive, harmful, inaccurate, or deceptive. Please use
caution, common sense, and safety when using our site. You are solely
responsible for your interactions with other Eelam Matrimony members. Because we
are not involved in member interactions, in the event that you have a dispute
with one or more members or those who have posted, viewed, or used information
on the Eelam Matrimony, you release Eelam Matrimony from claims, demands and
damages (actual and consequential) of every kind and nature, known and unknown,
suspected and unsuspected, disclosed and undisclosed, arising out of or in any
way connected with such disputes. Eelam Matrimony reserves the right, but has no
obligation, to monitor disputes between you and other members.
If there is any dispute about or involving the Eelam Matrimony and You, by using
the Site, You agree that the dispute will be governed by the laws of Canada
without regard to its conflict of law provisions. You agree to personal
jurisdiction by and venue in the courts of Canada.
5.5. Termination of Account
You agree that Eelam Matrimony may, under certain circumstances and without prior
notice, immediately terminate your Eelam Matrimony account, any associated email
address, and access to the Service. Cause for such termination shall include,
but not be limited to, (a) br /eaches or violations of the Terms and Conditions
of Use or other incorporated agreements or guidelines, (b) requests by law
enforcement or other government agencies, (c) a request by you (self-initiated
account deletions), (d) discontinuance or material modification to the Service
(or any part thereof), (e) unexpected technical or security issues or problems,
(f) extended periods of inactivity, (g) you have engaged in fraudulent or
illegal activities, and/or (h) nonpayment of any fees (if any) owed by you in
connection with the services provided by Eelam Matrimony. Termination of your
Eelam Matrimony account includes (a) removal of access to all offerings within
the Service, including but not limited to email access and messaging service.
(b) deletion of your password and all related information, files and content
associated with or inside your account (or any part thereof), and (c) barring
further use of the Eelam Matrimony. Further, you agree that all terminations for
cause shall be made in Eelam Matrimony sole discretion and that Eelam Matrimony
shall not be liable to you or any third-party for any termination of your
account.
7. Rights of Eelam Matrimony
Eelam Matrimony reserves the right to introduce, modify, or cancel any service
provided by Eelam Matrimony site in part or in full. Eelam Matrimony reserves the
right, but is not obligated, to edit, suspend or delete your profile without
any prior notice, as it deems fit to use of finding life partner. If we find
duplicate profiles then we have rights to suspend any of the profile or all the
profiles. With respect to Content you submit or make available for inclusion on
publicly accessible areas of Eelam Matrimony, the license to use, distribute,
reproduce, modify, adapt, publicly perform and publicly display such Content on
the Service solely for the purposes of finding life partner and promoting the
Eelam Matrimony service to which such Content was submitted or made available.
This license exists only for as long as you elect to continue to include such
Content on the Eelam Matrimony and will terminate at the time you remove or
Eelam Matrimony removes such Content from the Eelam Matrimony site and Service.
7. Disclaimers
Eelam Matrimony is not responsible for any incorrect or inaccurate content posted
on the Eelam Matrimony site or in connection with the Eelam Matrimony service,
whether caused by users, members or by any of the equipment or programming
associated with or utilized in the service, nor for the conduct of any user
and/or member of the Eelam Matrimony whether online or offline. Eelam Matrimony
assumes no responsibility for any error, omission, interruption, deletion,
defect, delay in operation or transmission, communications line failure, theft
or destruction or unauthorized access to, or alteration of, user and/or member
communications. Eelam Matrimony is not responsible for any problems or technical
malfunction of any telephone network or lines, computer on-line-systems,
servers or providers, computer equipment, software, failure of email or players
on account of technical problems or traffic congestion on the Internet or at
any website or combination thereof, including injury or damage to users and/or
members or to any other person's computer related to or resulting from
participating or downloading materials in connection with the Eelam Matrimony
site and/or service. Under no circumstances Eelam Matrimony be responsible for
any loss or damage resulting from anyone's use of the Eelam Matrimony site or the
service and/or any content posted on the Eelam Matrimony site or transmitted to
Eelam Matrimony Members. The Eelam Matrimony site and service are provided "AS-IS"
and Eelam Matrimony expressly disclaims any warranty of fitness for a particular
purpose or non-infringement. Eelam Matrimony cannot guarantee and does not
promise any specific results from use of the Eelam Matrimony site and/or service.
Eelam Matrimony does not warrant that this site and service or messages exchanged
are free of software viruses or any other computer code, files or programs
designed to interrupt, destroy or limit the functionality of any computer
software or hardware or telecommunications equipment.
8. Limitations on Liability
Except in jurisdictions where such provisions are restricted (and in that event
liability is disclaimed to the fullest extent permitted by law), in no event
will Eelam Matrimony be liable to you or any third person for any indirect,
consequential, exemplary, incidental, special or punitive damages, including
also lost profits arising from your use of the Site or the Eelam Matrimony
service, even Eelam Matrimony has been advised of the possibility of such
damages. Notwithstanding anything to the contrary contained herein,
Eelam Matrimony's liability to you for any cause whatsoever, and regardless of
the form of the action, will at all times be limited to the amount paid, if
any, by you to Eelam Matrimony for the service during the term of membership.
9. Arbirtation - Alternative Dispute Resolution
Any and all disputes arising out of or related to these Terms and Conditions of
use and/or your relationship with Eelam Matrimony and/or your use of
Eelam Matrimony site shall be submitted to binding arbitration according to the
rules of the Canadian Commercial Arbitration Center (CCAC). The parties to the
arbitration shall evenly divide any and all costs of the arbitration. Neither
party shall be entitled to attorney fees. All parties submit to exclusive
jurisdiction in the province of Ontario, Canada. The arbitration shall take
place exclusively in Ontario Canada before and arbitrator or mediator acredited
by CCAC practitioner and shall be governed by Ontario, Canada Law without
regard to its conflict of law provisions.
